Terms and conditions for use of Pion electronic journals
A Customer's manually signed licence agreement, if applicable, will supersede any conflicting terms in the licence below.

This document sets out the terms on which Pion Limited will make electronic access to its journals available via its server (the Server) to Authorised Users.

1. Scope of Licence

This Agreement permits simultaneous access to those journals by Authorised Users at the Subscribing Institution identified by the Subscribing Institution's Internet Protocol addresses (IP addresses) representing a single, local network at the Subscribing Institution's nominated site. Subscribing Institution is granted a nonexclusive and nontransferable licence to access Pion Journals.

2. Authorised Users

"Authorised Users" means only the employees, faculty, staff, and students officially affiliated with the Subscribing Institution's library facilities, and persons affiliated with remote sites or campuses of the Subscribing Institution that are administered from the Subscribing Institution's site or campus (but not persons affiliated with remote sites or campuses with a separate administrative staff). "Authorised Users" may also include users from general public (walk-in users) who are permitted by the Subscribing Institution to access the journals from designated terminals within the Subscribing Institution's IP address range as registered. Any proxy servers within the range of authorised IP addresses must either be configured to reject forwarding requests from nonauthorised users or Pion Ltd must be notified of the IP addresses of these servers so they can be removed from the authorised range. Pion Ltd may refuse to grant a licence to an institution claiming a range of IP addresses that appear to exceed the scope of this licence.

3. Availability

Pion Ltd shall use all reasonable endeavours to make the Server available to the Subscriber on a 24 hour basis, but if the Authorised Users' access is suspended or interrupted or a fault or defect occurs which prevents access to the Server, Pion Ltd's liability shall be limited to restoring access to the Server as soon as reasonably practicable. Otherwise Pion Ltd shall have no other liability to the Subscriber.

4. Duration of Agreement and Perpetual Access

This Agreement shall become effective upon acceptance by the Publisher of an online registration form filled out by the Subscribing Institution and, subject to its terms and conditions, will remain in effect so long as the Subscribing Institution maintains current print subscriptions that include online access to the journals. This Agreement will terminate in respect of any title if and when the subscription to it lapses, subject to the proviso that the Subscribing Institution shall continue to have access only to the volumes of each title for which subscriptions had been duly paid for as long as is practicable. Perpetual access to purchased volumes does not apply to subscriptions prior to year 2000 volumes in the case of Environment & Planning journals, and 1999 in the case of Perception.

5. Copyright

Pion online journals and their contents, including abstracts, are copyrighted by notices shown in the legal journals and are subject to all applicable copyright, database protection, and other rights of the copyright owner and publisher. Copyright notices in Pion journals may not be removed, obscured, or modified in any way. Neither Authorised Users nor the Subscribing Institution shall have any proprietary right in any of the journals by reason of their access to them.

6. Permitted Use

The Subscriber and Authorised Users are permitted:
a) To download and copy information from Pion electronic journals and retain it as long as they wish for personal or educational use to the same extent as the print edition of the publication.
b) To store the information electronically, provided the use is consistent with the other conditions described in this documentation.
c) The Subscriber may use the Pion online journals subscribed to or purchased at the full institutional price for the purpose of supporting Interlibrary Loan requests for non-commercial use by supplying one copy of an article. The article may be sent by post, fax, or electronically (in this case users may not forward it to others).
d) Other recompiling, copying, publication, or republication of the data, or any portion thereof, in any form or medium whatsoever, may be done only with specific written permission from the Publisher.

7. Liability

These terms and conditions are subject to change at the discretion of Pion Ltd following sixty (60) days written notice to the Subscriber. Although Pion Ltd takes every reasonable care to ensure that the information, data and other material when placed on the Server are error-free and up-to-date, Pion Ltd cannot accept responsibility for any corruption to the information, data, and other material thereafter, including but not limited to any defects caused by the transmission or processing of the information, data and other material. The Subscriber shall make reasonable efforts to make Authorised Users aware of these terms and conditions, and shall inform Pion Ltd if it becomes aware of a breach, and cooperate with Pion Ltd to stop the breach as soon as possible. The Subscriber takes every reasonable care to ensure that storage, display, access and security measures do not contradict these terms and conditions. Pion reserves the right to disallow specific usage exceeding that intended under these terms and conditions.
